Purchasing Policies

For the purposes of this document, anytime I refer to my website below I am talking about RecreationalKnivesAndFlashlights.com and/or the company (MW Plank Enterprises, LLC) that runs it.

Age Restriction

You must be at least 18 years of age to purchase a knife and/or axe from this website.

Most states and cities have restrictions on the size and type of knife you can carry either concealed or out in plain view.  It is up to you to comply with all laws that are in effect in the area where you live.

You must be at least 13 years of age to purchase any non-knife related item on this website.  You also must have permission to place said order from a parent or legal guardian.

Payment Options

I accept the following forms of payment:

Credit Card -- Visa, Mastercard, American Express, and Discover.

When you place your order, your credit card will be charged.  If the item(s) you ordered have not shipped within 7 days then your credit card will be voided/credited.  It will then be recharged when the item ships.

Note: If after 7 days your order has not shipped, you have the option of canceling your order at that time. 

I also except orders over the phone.

Just give me a call at 1-888-732-6152.  My office hours are Monday thru Friday from Noon till 7pm MST.  Outside these hours you can leave me a message telling me when it's a good time to give you a call back.

Order Changes

Should you need to make changes to your order once it has been placed, you need to give me a call at 1-888-732-6152 and I will do my best to accommodate you.

Shipping

UPS Ground is my standard method of shipment.

However, other methods are available.  Just give me a call at 1-888-732-6152 to find out what is available.

Parcels are insured at the published carrier insurance rate.

A shipping discount automatically occurs when at least 4 items are purchased at the same time.

The discount will increase with each additional item purchased.

Inspection of Products Upon Receipt

When your package arrives you must inspect your purchases.  Check out my return policy for more information.

Limitation of Liability

This website shall have no liability whatsoever beyond the remedies set forth herein, including, without limitation, loss of data, lost profits, loss of business, or other consequential, special, indirect or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein.  This limitation of liability applies both to products and services you purchase under this agreement.  In no event shall the total aggregate liability for this website exceed the amounts paid by you for the products or services.  Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Warranties

This warranty gives you specific legal rights.  You may also have other rights that vary from state to state.  The limited warranties applicable to the products are included in the documentation along with the products.  This website makes no express warranties except those stated in this section.

This website does not provide a warranty on any of the products sold.  All warranties for products are the responsibility of the manufacturer of said products.

This website disclaims all other warranties, express or implied, including, without limitation, warranties of quiet enjoyment and non-infringement, merchantability for computer programs and implied warranties of merchantability, fitness for a particular purpose and informational content.  This website reserves the right to modify its warranty at any time, in its sole discretion.  If there is any software provided with the products, it is provided subject to the license agreement that is part of the package.  You will be bound by the license agreement once the package is opened or its seal is broken.  This website does not warrant any software under this Agreement.  Warranties, if any, for the software are contained in the license agreement that governs its purchase and use.  Some states limit or disallow certain disclaimers of warranties, so certain portions or all of the above disclaimers may not apply to you.

What this means is that you need to contact the manufacturer for any warranty claims.

Note: If you have a problem returning a product to the manufacturer, you can contact me and I will do my best to help you out.

As stated above you are required to be 18 yrs of age in order to purchase a knife and/or axe from this website.  By making such purchase you acknowledge that this is indeed the case.  You also acknowledge that you will comply with all knife laws that are in effect in your area of residence.  Non-knife related items can be purchase by individuals who are at least 13 yrs of age.  By ordering items from this website you acknowlege that this is indeed the case, and that you have permission from a parent or legal guardian to place said order.

Please note that I do my best to make sure that the information on this website is accurate.  However, it is possible that some incorrect information might slip through and appear on this website.  By using this website you acknowlege that this could be the case and will not hold this website responsible for any incorrect information that might appear on this website.  Also, since I have no control of the content of websites that this website might link to, you agree to not hold this website responsible for the content of any linked website.

Throughout this website you will notice that I have made various comments about some of the products that I sell.  This information is based on either personal experience with said item or is based on information I have received from other sources.  By their very nature these statements are personal preferences either of myself or someone else, and it is possible for someone to have an experience with a product that contradicts either in whole or in part said comments.  By using this website you acknowledge that this could be the case and agree not to hold this website responsible or liable for said experience.

You agree and represent that you are buying for your own use only, or as a gift for someone else, and not for resale.

Severability

If any provision of these policies shall be ruled unenforceable, then the remainder shall be enforced to the extent permissible.

Force Majeure

This website shall not be in default by reason of any failure in performance of this Agreement if such failure arises, directly or indirectly, out of causes reasonably beyond the direct control or foreseeability of such party, including but not limited to, default by subcontractors or suppliers, acts of God or of the public enemy, terrorism, U.S. or foreign governmental acts in either a sovereign or contractual capacity, labor, fire, flood, epidemic, restrictions, strikes, freight embargoes, and/or banking and financial institution interruption.
